John Yoo and John Eastman


Both Professors John Yoo and John Eastman were law clerks for U.S. Supreme Court Justice Clarence Thomas, and both share many opinions on law and public policy, but in this program, their divergent views on the landmark decision in Obergefell v. Hodges will be tackled.   Obergefell v. Hodges is the June 2015 Supreme Court decision that extended the 14th Amendment to find a fundamental right to marry for persons of the same sex.

Prof. John Yoo is the Emanuel S. Heller Professor of Law at the University of California Berkeley Law School.  Professor Yoo is a visiting scholar at the American Enterprise Institute and has been a visiting professor at Chapman Law School, the University of Chicago, and the Free University of Amsterdam, and he held the Fulbright Distinguished Chair in Law at the University of Trento. From 2001-03, served as a deputy assistant attorney general in the Office of Legal Counsel at the U.S. Department of Justice, where he worked on issues involving foreign affairs, national security and the separation of powers.

Dr. John C. Eastman is the Henry Salvatori Professor of Law & Community Service at Chapman University Fowler School of Law, and also served as the School's Dean from June 2007 to January 2010, when he stepped down to pursue a bid for California Attorney General. He is the Founding Director of the Center for Constitutional Jurisprudence, a public interest law firm affiliated with the Claremont Institute, and Chairman of the National Organization for Marriage.
