Bob Barr represented the 7th District of Georgia in the U. S. House of Representatives from 1995 to 2003, and now practices law in Atlanta, Georgia. He also serves Of Counsel with the Law Offices of Edwin Marger in Jasper, Georgia. Congressman Barr runs a consulting firm, Liberty Strategies, Inc.

From 2003 to 2008, he occupied the 21st Century Liberties Chair for Freedom and Privacy at the American Conservative Union, and now is a member of The Constitution Project’s Initiative on Liberty and Security. From 2003 to 2005 Bob was a member of a project at Harvard University’s Kennedy School of Government addressing matters of privacy and security. Barr serves as a board member for Privacy International, a privacy watchdog group headquartered in London. Recognizing Bob Barr’s leadership in privacy matters, former New York Times columnist William Safire called him “Mr. Privacy.” Barr was the Libertarian Party nominee for President in 2008. Bob serves on the boards of directors for the National Rifle Association and 1Force, a company providing domestic and international security.

Bob was appointed by President Reagan as the United States Attorney for the Northern District of Georgia (1986-90), and served as President of Southeastern Legal Foundation (1990-91). He was an official with the CIA from 1971-78. Additionally, he served as an official member of the U.S. delegation at several major United Nations conferences. Bob Barr was awarded his law degree from Georgetown University; his master's degree from The George Washington University and his bachelor's degree from the University of Southern California.

Ronald D. Rotunda, The Doy & Dee Henley Chair and Distinguished Professor of Jurisprudence, joined the faculty in 2008. Before that, he was University Professor and Professor of Law at George Mason University School of Law. He is a magna cum laude graduate of Harvard College and a magna cum laude graduate of Harvard Law School, where he was a member of Harvard Law Review. He served as assistant majority counsel for the Watergate Committee.

He has co-authored the most widely used course book on legal ethics, Problems and Materials on Professional Responsibility (Foundation Press, 10th ed. 2008) and is the author of a leading course book on constitutional law, Modern Constitutional Law (West Publishing Co., 9th ed. 2009). He is the coauthor of, Legal Ethics: The Lawyer's Deskbook on Professional Responsibility (ABA-West Group, St. Paul, Minnesota, 7th ed., 2009) (jointly published by the ABA and West Group, a division of Thompson Publishing) (with John Dzienkowski). Rotunda is also the co-author (with John Nowak) of the six volume Treatise on Constitutional Law (West Publishing Co., 4th ed. 2007-2008), and a one volume Treatise on Constitutional Law (West Publishing Co., 8th ed. 2010). He is also the author of several other books and more than 300 articles in various law reviews, journals, newspapers, and books in this country and in Europe. His works have been translated into French, German, Romanian, Czech, Russian, and Korean.

In 1993 he was the Constitutional Law Adviser to the Supreme National Council of Cambodia and assisted that country in writing its first democratic constitution. The 2002-2003 New Educational Quality Ranking of U.S. Law Schools (EQR) ranks Professor Rotunda as the eleventh most cited of all law faculty in the United States. On June 17, 2009, he became a Commissioner of the Fair Political Practices Commission, a state regulatory agency and California’s independent political watchdog. He will serve until January 31, 2013.

Francis J. Beckwith is Professor of Philosophy and Church-State Studies at Baylor University. With his appointment in the Department of Philosophy, he also teaches courses in the Departments of Political Science and Religion as well as the J. M. Dawson Institute of Church-State Studies, where he served as its Associate Director from July 2003 until January 2007. He is also a Resident Scholar in Baylor's Institute for Studies of Religion (ISR).

Prof. Beckwith is a graduate of Fordham University (Ph.D. and M.A. in philosophy), he also holds the Master of Juridical Studies (M.J.S.) degree from the Washington University School of Law in St. Louis. In 2008-09 he served on the faculty of the University of Notre Dame as the Mary Ann Remick Senior Visiting Fellow in Notre Dame's Center for Ethics & Culture. A 2002-03 Research Fellow in the James Madison Program in American Ideals and Institutions in the Department of Politics at Princeton University, Professor Beckwith currently serves as a member of Princeton's James Madison Society. He has also held full-time faculty appointments at Trinity International University (1997-2002), Whittier College (1996-97), and the University of Nevada, Las Vegas (1989-96).

On June 20, 2011, the United States Supreme Court decided the Case of Wal-Mart v. Dukes where the issue on appeal is the certification of 1.6 million current and former female Wal-Mart employees as a class under Federal Rule of Civil Procedure 23(b)(2). Attorneys on behalf of the proposed class have argued that the systemic discrimination has impacted all women employed at Wal-Mart and that this the high cost of litigation, in light of what are expected to be relatively small individual recoveries, requires that litigation proceed in this manner. Wal-Mart has responded that the proposed class, which is larger than the combined active duty of the Army, Navy, Air Force, Marines and Coast Guard, is comprised of women at all levels of employment within the company and in a variety of different work environments and therefore lacks the element of commonality needed to certify a class.

Panelists

Anthony J. Oncidi heads the Labor & Employment Law Group in the Los Angeles office of Proskauer Rose. Tony represents employers and management in all aspects of labor relations and employment law. A substantial portion of Tony’s practice involves the defense of employers in large class actions, employment discrimination, harassment and wrongful termination litigation in state and federal court as well as arbitration proceedings, including FINRA matters. Tony is the author of the treatise titled Employment Discrimination Depositions (Juris Pub’g 2009), co-author of Proskauer on Privacy (PLI 2009), and, since 1990, has been a regular columnist for the official publication of the Labor and Employment Law Section of the State Bar of California and the Los Angeles Daily Journal. Tony also is a regular commentator on employment-related issues for radio, television, and print media. He is an appointed Hearing Examiner for the Los Angeles Police Commission Board of Rights and has served as an Adjunct Professor of Law and a guest lecturer at USC Law School and a guest lecturer at UCLA Law School.

John Shu is an attorney and expert on political issues, the Supreme Court, and confirmations. Mr. Shu served both President George H.W. Bush and President George W. Bush. He also served Judge Paul Roney, U.S. Court of Appeals for the 11th Circuit, who was also on the Foreign Intelligence Surveillance Court of Review, and Judge Stanley Sporkin, U.S. District Court for the District of Columbia, who formerly served as Director of Enforcement at the Securities & Exchange Commission and General Counsel at the Central Intelligence Agency. Mr. Shu has lectured and published articles on a wide variety of issues such as constitutional law, the Foreign Corrupt Practices Act, securities and corporate law, regulatory affairs, antitrust, appellate advocacy, intellectual property, and international affairs.

Andrew H. Friedman, partner with the law firm of Helmer & Friedman LLP, primarily represents employees in all aspects of employment law. Mr. Friedman received his J.D. degree from Cornell Law School and his B.A. degree in history and psychology, cum laude, from Vanderbilt University. J. Christian Adams is the founder of the Election Law Center, in McLean, Virginia. He served in the Voting Section at the United States Department of Justice where he brought a wide range of election cases to protect racial minorities ranging from vote dilution to redistricting lawsuits. He has also brought cases involving military voting protections and voter intimidation cases, including one against the New Black Panther Party. He litigated the successful Voting Rights Act case of United States vs. Ike Brown, marking the first use of the law to protect a discriminated against white minority. Prof. David Bernstein is Foundation Professor at George Mason Law School and is a regular contributor to the Volokh Conspiracy blog. Professor Teresa Collett of the University of St. Thomas School of Law was a candidate for Minnesota's 4th Congressional District in the last national election. She has served as special Attorney General for the States of Oklahoma and Kansas , as well as assisting other state Attorneys General in defending laws protecting human life and marriage. Prior to joining St. Thomas in 2003, Professor Collett taught at the South Texas College of Law where she established the nation's first annual symposium on legal ethics. Most recently she represented Congressman Ron Paul and various medical groups in the defense of the federal ban of partial-birth abortion, and the Governors of Minnesota and North Dakota defending the N.H. requirement of state parental involvement prior to performance of an abortion on a minor before the United States Supreme Court. She is often asked to represent the interests of government officials before federal appellate courts. Prof. Collett has published numerous legal articles and is the co-author of a law casebook on professional responsibility and co-editor of a collection of essays exploring "Catholic" perspectives on American law.

The Use of Drones and Targeted Killings in Counterterrorism

Shortly after September 11, 2001, President George W. Bush, as Commander in Chief, authorized unmanned aerial vehicles (UAVs), or drones, to target and kill enemy leaders pursuant to Congress' Authorization for Use of Military Force (AUMF) against al Qaeda. The President designated "Afghanistan and the airspace above" a combat zone, but the United States also launched drone strikes against al Qaeda targets in other countries. The drone program received widespread attention in November 2002, when the C.I.A. launched a Predator drone strike in Yemen, killing the mastermind of the October 2000 attack on the U.S.S. Cole and six other men. Following the Yemen attack, the United Nations Special Rapporteur on Extrajudicial, Summary or Arbitrary Executions asserted that the attack was "a clear case of extrajudicial killing." In response, the U.S. defended the drone strike as permissible under international law of armed conflict, broadly asserting that al Qaeda terrorists who continue to plot attacks may, in appropriate circumstances, be lawful subjects of armed attack without regard to their location. One of the 94 French Attorneys of the Supreme Court of France, Maitre Francois-Henri Briard was the first to argue a case of constitutional review before the French Constitutional Court this summer. The French now practice judicial re-view and pre-view processes to test legislative initiatives for efficacy. Maitre Briard will speculate how this process will be applied to a case like the recent legislative vote to ban the burqa. He will also provide insight into current French cultural, economic, and legal conditions.

Francois Briard is a close friend of America and is an honorary inductee to the Sons of the American Revolution. He has recently argued in defense of Israel against war crimes charges at the European Union’s International Criminal Court. Francois Briard is a member of President Sarkozy’s “Inner Circle” of advisors. Prof. Christopher S. Yoo is Professor of Law, Communication, and Computer and Information Science and Director of the Center for Technology, Innovation, and Competition at the University of Pennsylvania. He is one of the nation’s leading authorities on law and technology. His research focuses on how economic theories of imperfect competition are transforming the regulation of the Internet and other forms of electronic communications. He has been a leading voice in the “network neutrality” debate that has dominated Internet policy over the past several years. He is also pursuing research on copyright theory as well as the history of presidential power. He is the author (with Daniel F. Spulber) of Networks in Telecommunications: Economics and Law (Cambridge, 2009) and (with Steven G. Calabresi) of The Unitary Executive: Presidential Power from Washington to Bush (Yale, 2008). Prof. Yoo testifies frequently before Congress, the Federal Communications Commission, and the Federal Trade Commission.

Mr. John Shaeffer, Esq. is the partner in charge of the Los Angeles office of Lathrop & Gage. He also teaches New Media Law at Santa Clara School of Law. Mr. Shaeffer has extensive litigation experience and has litigated some of this nation's largest and most challenging antitrust, product liability, intellectual property and environmental cases in both state and federal court. Prof. Larry Downes is a consultant and speaker on developing business strategies in an age of constant disruption caused by information technology. Professor Tom Bell joined the faculty of Chapman University School of Law in 1998. He specializes in high-tech legal issues and has written a variety of papers on Intellectual Property and Internet Law. Professor Bell received his JD from the University of Chicago Law School in 1993, where he served both as a member of the University of Chicago Law Review and as Articles Editor and cofounder of the University of Chicago Legal Roundtable. Prior to joining the Chapman faculty, he served as Director of Telecommunications and Technology Studies at the Cato Institute in Washington, D.C. John Yoo received his B.A., summa cum laude, in American history from Harvard University. Between college and law school, he worked as a newspaper reporter in Washington, D.C. He received his J.D. from Yale Law School, where he was an articles editor of the Yale Law Journal. He then clerked for Judge Laurence H. Silberman of the U.S. Court of Appeals of the D.C. Circuit.
Professor Yoo joined the Boalt faculty in 1993, then clerked for Justice Clarence Thomas of the U.S. Supreme Court. He served as general counsel of the U.S. Senate Judiciary Committee from 1995-96. From 2001 to 2003, he served as a deputy assistant attorney general in the Office of Legal Counsel at the U.S. Department of Justice, where he worked on issues involving foreign affairs, national security and the separation of powers.
Professor Yoo has been a visiting professor at the University of Chicago and the Free University of Amsterdam, and he held the Fulbright Distinguished Chair in Law at the University of Trento, Italy in 2006. He has received research fellowships from the University of California, Berkeley, the Olin Foundation and the Rockefeller Foundation, and is a visiting scholar at the American Enterprise Institute. Professor Yoo also has received the Paul M. Bator Award for excellence in legal scholarship and teaching from the Federalist Society for Law and Public Policy. He has testified before the judiciary committees of the U.S. Senate and House of Representatives, and has advised the State of California on constitutional issues.

Bob Barr represented the 7th District of Georgia in the U. S. House of Representatives from 1995 to 2003, and was the 2008 Libertarian Party nominee for President of the United States. He practices law with the Law Offices of Edwin Marger, and runs a consulting firm, Liberty Strategies, Inc., headquartered in Atlanta, Georgia. Barr is a registered Mediator and Arbitrator.
From 2003 to 2008, he occupied the 21st Century Liberties Chair for Freedom and Privacy at the American Conservative Union. Since 1997 he has been a Board Member of the National Rifle Association. Dean Canova is the Associate Dean for Academic Affairs and Betty Hutton Williams Professor of International Economic Law at Chapman University School of Law. Since the 1980s he has written critically about the deregulation of banking and finance from an institutional law and Keynesian economics perspective. As a legislative aide to the late U.S. Senator Paul Tsongas, he published a critique of the bailout of Continental Illinois National Bank & Trust and the “Too Big to Fail Doctrine” and anticipated the collapse of the savings & loan industry. In the 1990s, prior to the Asian currency contagion, he argued against the liberalization of capital accounts and warned of an impending crisis in the bubble economy. In 1996 he argued in the New York Times and elsewhere against the reappointment of Alan Greenspan as Chairman of the Federal Reserve Board and soon warned of the growing housing bubble and threat of deflation. Dean Canova continues to advocate for well regulated financial markets, accountability and the rule of law in central banking, a return to Greatest Generation principles of functional finance, and the use of advanced information technologies to make regulation more effective and the global financial architecture more transparent. Dean Canova practiced law in New York City with Gibson, Dunn & Crutcher. He has taught previously at the University of Miami School of Law, the University of Arizona College of Law, and the University of New Mexico School of Law.

Dr. John R. Lott Jr. is an economist and leading expert who's studied President Obama's and Congress's plans for healthcare reform. Erwin Chemerinsky is the dean of the new UCI Law School. He is a graduate of Northwestern University and Harvard Law School. He previously taught at the USC, Depaul and Duke Law Schools. In an extraordinary session on September 8, the Supreme Court heard arguments in Citizens United v. FEC. At issue, according to Scotusblog writer Lyle Denniston, is whether "the Court was ready to overturn two of its precedents -- one from 1990, the other from 2003 -- upholding such limitations" on congressional restrictions of corporate influence in campagins for the Presidency and Congress. Also see an op-ed by Ted Olson, who argued the case for Citizens United and hopes for a possible "free speech do-over."

In recognition of Constitution Day, Prof. Anthony Caso will address the corporate campaign speech issues presented in the recently argued Supreme Court case: Citizens United v. FEC. Prof. Caso submitted an amicus brief in the Citizens United case on behalf of the Center for Constitutional Jurisprudence.

Prof. Anthony T. Caso earned his J.D. from University of the Pacific, McGeorge School of Law and M.B.A. from Golden Gate University. For nearly 30 years, Professor Caso held a variety of positions at Pacific Legal Foundation, most recently serving as Senior Vice President and Chief Counsel. Presently, Professor Caso is a solo practitioner at the Law Office of Anthony T. Caso in Sacramento, California, where he practices appellate litigation with a concentration on complex statutory and constitutional issues. Professor Caso's litigation experience includes successful cases at every level of the state and federal court system, including the California Supreme Court and the United States Supreme Court. Professor Caso is also an Adjunct Professor of State Constitutional Law at McGeorge School of Law and an adjunct professor at the University of San Francisco, College of Professional Studies. Since 2001, Professor Caso has served as a Master of the Bench for the Anthony M. Kennedy Inn of Court and is active in the Federalist Society Free Speech and Election Law Practice Group, Federalist Society of Sacramento, and the Boy Scouts of America. Professor Caso has also given presentations in front of the Federal Bar Association and the Milton Schwartz American Inn of Court.

Guest: Judge James Rogan: Prior to his original appointment to the bench by Governor Deukmejian in 1990, Judge Rogan was a gang murder prosecutor in the Los Angeles County District Attorney's office; California Lawyer Magazine named him as one of the state's most effective prosecutors. After he resigned from the bench in 1994, Judge Rogan won election to the California State Assembly, where he later served as majority leader. Elected to the United States House of Representatives in 1996, he was Assistant Majority Whip. A member of both the House Commerce Committee and the House Judiciary Committee, Judge Rogan was one of the lead prosecutors in the United States Senate impeachment trial of President Clinton in 1998-1999. Judge Rogan later served as U.S. Under Secretary of Commerce for Intellectual Property and as Director of the U.S. Patent and Trademark Office. Judge Rogan returned to private law practice in 2004; in 2006 Governor Schwarzenegger appointed him to the Superior Court of California. In 2007 President Bush nominated him to be a federal judge for the United States District Court for the Central District of California; his nomination is pending currently before the United States Senate. Judge Rogan earned his Bachelor of Arts degree from the University of California at Berkeley and his Juris Doctor from UCLA School of Law, where he served on the UCLA Law Review. Prof. Robert Turner co-founded the Center for National Security Law with Professor John Norton Moore in April 1981 and has served as its Associate Director since then except for two periods of government service in the 1980s and during 1994-95, when he occupied the Charles H. Stockton Chair of International Law at the U.S. Naval War College in Newport, Rhode Island. A veteran of two Army tours in Vietnam, he served as a Research Associate and Public Affairs Fellow at Stanford's Hoover Institution on War, Revolution and Peace before spending five years in the mid-1970s as national security adviser to Senator Robert P. Griffin, a member of the Senate Foreign Relations Committee. He has also served in the Pentagon as Special Assistant to the Under Secretary of Defense for Policy, in the White House as Counsel to the President's Intelligence Oversight Board, at the State Department as Principal Deputy Assistant Secretary for Legislative Affairs, and as the first President of the congressionally established United States Institute of Peace.

A former three-term chairman of the ABA Standing Committee on Law and National Security (and for many years editor of the ABA National Security Law Report), Prof. Turner has taught undergraduate courses at Virginia on international law, U.S. foreign policy, the Vietnam War, and foreign policy and the law in the Woodrow Wilson Department of Government and Foreign Affairs, in addition to co-teaching with Moore the law school seminars Advanced Topics in National Security Law I & II. The author or editor of more than a dozen books and monographs (including coeditor of the Center's National Security Law and National Security Law Documents) and numerous articles in law reviews and professional journals, Prof. Turner has also contributed articles to most of the major U.S. newspapers and has testified before more than a dozen different congressional committees on issues of international or constitutional law and related topics.

Professor Baker is the Dale E. Bennett Professor of Law at Louisiana State University School of Law. Since 1999, he has been an Invited Professor at the University of Lyon III (France). He has taught a number of short-courses on separation of powers with Supreme Court Justice Antonin Scalia and has argued cases before the Supreme Court. He was a Fulbright scholar in the Philippines and earned a Ph.D. from the University of London.

Stephen Bainbridge will discuss the "New" New Deal, what the Paulson Bailout was and whether it was necessary, what the policy results will be, and what the practical results mean for you.

Prof Bainbridge is one of the nation's foremost corporate layers, is the William D. Warren Professor of Law at UCLA, where he currently teaches Business Associations, Unincorporated Business Associations, and Advanced Corporation Law. In past years, he has also taught Corporate Finance, Securities Regulation, Mergers and Acquisitions, and seminars on corporate governance. Prof. Bainbridge has written more than 50 monographs for legal journals, including such leading publications as the Harvard Law Review, the Virginia Law Review, the Northwestern University Law Review, the Cornell Law Review, the Stanford Law Review and the Vanderbilt Law Review. He has also written a number of legal textbooks. Although much of his writing has been of a technical nature, he has developed considerable experience in writing for a general audience in his capacity as a weekly columnist for the TCS Daily e-zine (http://www.tcsdaily.com/).

The same sex marriage discussion is not just cultural, religious, and historical; it also has wide-ranging legal implications. From the Defense of Marriage Act (DOMA) provisions – to constitutional full-faith-and-credit-clause ramifications -- to equal protection and state fairness/discrimination issues -- there is much to contemplate. Dean McConville and Jordan Lorence will present these issues from their perspectives on either side of this debate.

Dean Celestine McConville - Dean McConville joined the Chapman Law faculty as an Associate Professor in August 2000. She clerked for Chief Justice William H. Rehnquist and also served as clerk to Judge Cynthia Holcomb Hall on the United States Court of Appeals for the Ninth Circuit, and for Judge Donald C. Nugent on the United States District Court for the Northern District of Ohio. Before coming to Chapman, she was a visiting faculty member at Case Western Reserve School of Law, where she received the Student Bar Association's Teacher of the Year award for 1999. She earned her J.D. from Georgetown University Law Center, graduating magna cum laude in the top one percent of her class. She was selected for Order of the Coif and was editor for the Georgetown Law Journal's Criminal Procedure Project. Dean McConville practiced law as an associate with Shea & Gardner in Washington, D.C.

Jordan Lorence, Esq. - A graduate of Stanford University, Jordan W. Lorence earned his juris doctor at the University of Minnesota Law School. After graduation from law school he served as a staff attorney for the Minnesota State Senate. He began practicing law in 1981, specializing in constitutional law. He spent several years working with public interest organizations and is now a litigation attorney for the Alliance Defense Fund. Jordan Lorence has had extensive trial experience, especially in the area of First Amendment litigation.

Moderator: John Shu, Esq. – John Shu has published several white papers on the subject of same sex marriage as he has comprehensively monitored, analyzed, and compared the cases across the United States. He is an associate with Straddling, Yocca, Carlson & Rauth in Irvine and he clerked for The Honorable Paul H. Roney, United States Court of Appeals for the Eleventh Circuit.

Dr. John C. Eastman will give his annual roundup of the key cases of last year's Supreme Court term as well as his predictions for the upcoming term. Dr. Eastmanwas appointed Dean of Chapman Law School and Donald P. Kennedy Chair in Law in June 2007. Previously, Dr. Eastman was Director of the Center for Constitutional Jurisprudence, a public interest law firm affiliated with the Claremont Institute that he founded in 1999. Prior to joining the Chapman Law faculty in August 1999, he served as a law clerk with Justice Clarence Thomas at the Supreme Court of the United States and with Judge J. Michael Luttig at the United States Court of Appeals for the Fourth Circuit. After his clerkships, Dr. Eastman practiced with the national law firm of Kirkland & Ellis, specializing in major civil and constitutional litigation at both the trial and appellate levels. Dr. Eastman earned his J.D. from the University of Chicago Law School, where he graduated with high honors in 1995. Dr. Eastman also has a Ph.D. and M.A. in Government from the Claremont Graduate School, with fields of concentration in Political Philosophy, American Government, Constitutional Law, and International Relations. Prior to law school, he served as the Director of Congressional & Public Affairs at the United States Commission on Civil Rights during the Reagan administration and was the 1990 Republican Nominee for Congress in California’s 34th District. He teaches Constitutional Law, Property, Legal History, First Amendment and Constitutional Litigation Clinic.
